Energy Incentive Agreement
By signing below, I request an incentive for the work listed on this form. I certify that this form and any accompanying documentation are complete and accurate, and that all measures associated with this project were completed as of the signature date below. I also understand that Chelan County PUD will make the final determination of any incentive that I may receive, and not all projects will qualify for incentives.

CHELAN COUNTY PUD HEREBY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES (INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE) AND SHALL NOT BE RESPONSIBLE FOR ANY REPRESENTATION OR PROMISE WITH RESPECT TO THE EQUIPMENT, MATERIALS OR LABOR REQUIRED FOR THE INSTALLATION OF ENERGY EFFICIENCY MEASURES ON THE PREMISES, OR THE COST OF SUCH EQUIPMENT, MATERIALS AND LABOR.
ADDITIONAL CONDITIONS

The incentives listed may apply to new and/or existing residential properties located in Chelan County and are current Chelan County PUD electric customers (“Participant”). Eligible properties include single-family and multi-family residences, including manufactured and modular homes, determined as follows:
a) Individually Owned Units. An individually owned residence within a multi-unit property (e.g. condominium) is treated as a single-family residence if the building contains one to four (1-4) units within the same structure. Buildings with five (5) or more units per structure are treated as multi-family residences regardless of ownership structure.
b) Multi-Family Apartment Complexes. A rental apartment complex or similar multi-unit residential property is treated as one residential service address and classified as single-family or multi-family based solely on the total number of units within the same structure, consistent with the guidelines described above.
c) Rental and Lodging Properties. Short-term rentals (e.g., vacation rentals, Airbnb, VRBO), long-term rental properties, condominiums, townhomes, cabins and other residential-style lodging are considered residential service. Such properties are classified as single-family or multi-family based on the number of units under the same roof.

Incentives apply only to conditioned (heated/cooled) space used as a residence. Electric heating and cooling systems must be permanently installed.

Participants are responsible for complying with all applicable codes and regulations.

Chelan County PUD reserves the right to inspect and verify energy efficiency measures and equipment prior to payment and will coordinate inspection as applicable.

Incentives are paid directly to the Participant by check.

Application must be submitted within 1 year of completion of energy efficiency measure.

Allow 6-8 weeks for processing and payment of incentive.
Any funding provided by Chelan County PUD under the agreement is at the request of the Participant. Because of the variability and uniqueness of individual energy use, it is not possible to predict exact energy savings (if any) that may accrue to any Participant. Chelan County PUD, by providing funding, does not warrant that the equipment will achieve any reduction in energy costs to the Participant.
Release: As consideration for participation in the Chelan County PUD’s Energy Efficiency Incentive Program, Participant hereby releases, indemnifies, defends, and holds harmless Chelan County PUD, its commissioners, officers, employees, and agents from and against any and all claims, demands, actions, causes of action, losses, damages, liabilities, costs, and expenses (including reasonable attorney’s fees) of any kind or nature whatsoever, whether brought by Participant or any third party, arising out of or relating to:
(a) the selection, purchase, design, installation, or performance of any energy efficiency measures at Participant’s residence;
(b) the acts or omissions of any contractor, subcontractor, material supplier, or other third party retained by Participant;
(c) any dispute regarding payment for labor, services, or materials related to such installation; or
(d) Participant’s application for, receipt of, or participation in the Program.
Participant acknowledges that Chelan County PUD does not select, employ, endorse, supervise, or control any contractor or third-party performing work at Participant’s residence and is not responsible for the quality, safety, legality, or performance of any such work.
Assignment: Participant may not assign, transfer, delegate, or otherwise convey any rights or obligations under this Agreement without the prior written consent of Chelan County PUD, which consent may be granted or withheld in Chelan County PUD’s sole discretion.
Attorney's fees: If any action is brought to enforce this Agreement, the prevailing party in such shall be entitled, in addition to any other relief, to award of reasonable attorney's fees and costs incurred in such action.
Reservation: Participant acknowledges and agrees that Chelan County PUD retains the sole and exclusive right, in its sole discretion, to reject, deny, adjust or amend any application and any incentive payments made pursuant to this Agreement and Chelan County PUD programs and policies. All incentive amounts, if any, shall be determined by Chelan County PUD's sole discretion. Participation in this program does not guarantee any incentive payment.
